TERMS AND CONDITIONS
Please note that by signing and submitting the aforesaid Application Form, you hereby agree and consent adhere to and be irrevocably bound by the terms and conditions contained herein unless PropCare Real Estate Management Services Pvt. Ltd. (“Propcare”) otherwise notifies in writing.
General Conditions:
Please fill all fields in capital letter in the form.
The name mentioned should be as mentioned in your original sale deed.

This Application (requisition form) is for a home owner requesting PropCare to assist them in searching a tenant in case of them intending to rent the flat or to search for a potential buyer in case they intend to sell the said flat.
This Application should be accompanied by a self attested copy of the Sale Deed. (This is only for the purpose of establishing absolute ownership of the Applicant over the said flat as mentioned in the Application Form).
Signature of the Applicant is a must in order to process the requisition. In case of Joint ownership, signatures of all the owners are a must.
In case of an owner/s assigning another person/company as his/her GPA (General Power of Attorney) Holder to the effect that the said person/company is allowed to transact on the said flat on behalf of the owner/s, the GPA should be registered and the original should be produced for verification and the self attested photo copy should be attached along with the application.
A set of keys are to be handed over at the Propcare office to the Manager in-charge at the respective Project.
Propcare is not responsible for any damage (wear & tear) or inappropriate condition of the flat.
Neither Propcare nor the owner/s are requested not entertain Consultants / Brokers / real estate agents or any other 3rd party who is intending to show the apartment to prospective tenants / buyers on behalf of the owners.

Propcare’s scope of services is to conduct a search for a tenant/buyer by means of advertisements, references, walk-ins etc.
Propcare does not take responsibility of any kind after the agreement has been executed between the Lessor & lessee (Owner & Tenant) in a rental service.
Propcare does not take responsibility of any kind after the agreement has been executed between the Seller & Purchaser (or Assignor & Assignee, if applicable) in the resale service.
Propcare does not take any responsibility of doing a background check of the potential tenant. Propcare would only collect & pass on the basic details of the prospect.
In the interest of the community & upon request by the other residents of the Apartment Complex, Propcare would prospect tenants only for families (Husband, wife, parents & children) and not for Bachelors, Spinsters, Shared accommodations by friends, blood related brothers & sisters or paying guests.
In cases of rental services, Propcare shall draft the rental/lease agreements on behalf of the owners and have the same franked and registered by the government authority, as the case may be, at the owner/s’ cost. .
In cases of resale services Propcare shall draft all agreements and other documents required for conducting the transaction on behalf of the owner/s. and have the same franked and registered by the government authority, as the case may be, at the owner/s’ cost. .
As and when necessary for the purpose hereof, Propcare may assist the buyer to liaison with the Developer/builder and or various government agencies in the interest of completing the transaction contemplated herein.
Propcare’s services are chargeable to the extent of the scope of services that are stated in the section that reads “Scope of services” and are subject to change without prior notice.
All other miscellaneous expenses billed/un-billed expenses are to be borne by the owner /tenant/buyer which includes but are not limited to charges (with & without receipt) by government agencies, fuel expenses, photo copying charges, printing & franking charges, etc.
Service Tax as applicable would be charged separately in the Invoice.
Scope of services:
Propcare’s scope of services hereunder is as follows:
To conduct a search for a tenant/buyer by means of advertisements, references, walk-ins etc.;
Conducting inspections with prospects of the proposed flat.
Obtaining feedback from the prospect upon inspection.
Negotiating on behalf of the owners on the price point.
Negotiating on the terms & conditions on behalf of the home owner in the set scope.
Preparing draft of agreements as required for the transaction.
Having the necessary documents franked by the authorised government agency and if need be, have the same registered at the cost of the buyer/tenant/owner, as the case may be.
Delivery of a copy of the signed & franked lease agreement to the home owners [for Rental Services].
Liaison with the developer/builder and or various government agencies with the interest of completing the transaction.
NRI services:
For those who want to enjoy the benefits of ownership without the hassle in handling tenants, we are providing Property Management service. Our service includes providing the client with updated market rates in the locality of property, if so requested by the client in writing.
PropCare may also provide services such as:
Collection Of rent.
Maintenance Work.
Legal support for the properties.
Inspection of flat Pre & Post delivery to tenant.
Advising Owners on the damages & possible cost estimation for repairs & replacements.
Assist in buying/selling a property.
Updating on Taxes, bills & other obligatory payments to be made by the owners.
(Above services is extended to any owner who wishes to avail this service who may be in this city or anywhere in the world (including this country).)
The charges for the aforesaid services, to the extent the same not being covered under the ‘Scope of Services’ specifically mentioned above, shall be intimated beforehand to the Owner on a case-to-case basis.

I/WE HERBY DECLARE THAT ALL INFORMATION STATED IN THIS REQUSITION FORM ARE TRUE TO THE BEST OF OUR KNOWLEDGE.
I/WE HERBY AGREE TO KEEP PROPCARE INFORMED ON ANY CHANGES THAT MAY HAVE OCCURED AFTER SIGNING OF THIS REQUSITION FORM THAT WOULD CHANGE THE STATUS OF ANY OF THE DETAILS IN THIS APPLICATION PRIOR TO US GETTING INTO ANY AGREEMTENT WITH THE CONCERNED OWNER/TENANT/BUYER.
